MWS Consulting Studio Checkout Terms

These terms cover everything you buy through checkout on mwsconsulting.studio: DIY website kits, Ready-Made websites and service packages.

  • Sections 1 to 13 apply to every purchase.
  • Sections 14 to 16 add the rules for each kind of product.

Please read them before you pay. When you check the box and pay, you agree to them, to our Refund Policy and, for kits, to the Kit License.

1. Who we are

MWS Consulting Studio is a division of Mental Wealth Solutions, Inc., a New York corporation in Floral Park, NY 11001. "We" and "us" mean Mental Wealth Solutions, Inc. You can reach us at hello@mwsconsulting.studio.

2. Who you are

  • If you're buying for a business, you confirm that you can agree to these terms for it. "You" then means the business.
  • If you're buying for yourself, you must be 18 or older.
  • Checkout is for buyers in the United States. If you're outside the US, contact us before buying.

3. What you're buying

  • You're buying the product as described on its page when you paid: what's included, what isn't, and any timeline. That description is part of these terms, and you get a copy with your receipt.
  • Anything not in the description is extra. We'll quote it in writing first, and nothing extra starts until you say yes in writing.
  • Larger or custom projects use a separate written agreement, not checkout.

4. Price, payment and sales tax

  • You pay the price shown at checkout, in US dollars, once. There are no subscriptions or automatic renewals at checkout. Monthly plans have their own sign-up and terms.
  • Kits are sold through Link, Stripe's merchant-of-record service.
    • Link is the seller for the payment. It collects any sales tax and sends your receipt.
    • Link's payment terms, shown at checkout, apply to the payment. These terms and the Kit License cover the kit itself.
    • Your card statement shows "LINK.COM*" followed by our name.
  • Ready-Made websites and service packages are sold by us, and Stripe processes the payment. Prices don't include sales tax. Where it applies, it's added at checkout.
  • We never see or store your full card number.

5. Health information and regulated businesses

  • Please don't send us health information about your patients or customers.
  • Healthcare providers covered by HIPAA: if a Ready-Made website or service package would let us see patient information, don't buy it at checkout. Contact us instead, because we need a business associate agreement first. If you buy one anyway, we cancel the order and refund you in full.
  • Kits: if you collect patient information through a kit's forms, keeping it safe and following HIPAA is your responsibility. Use tools that are set up for it.
  • Regulated trades: if your business is in one (for example, cannabis), contact us before buying. Some products and payment methods aren't available to you.

6. What we promise, and what we don't

  • We promise careful, skilled work, and products that match their descriptions.
  • We don't promise results we can't control:
    • SEO, AEO and GEO work is preparation. It never guarantees rankings, mentions in AI answers, or traffic.
    • We don't guarantee leads, revenue, uptime, or any speed or quality score.
    • We don't guarantee that any AI system is accurate, always available, or secure.
    • Finishing the technical work is one thing. Business results, like more calls or sales, are another, and we don't promise them.
  • We don't give legal advice or certify legal compliance. Compliance readiness is preparation, and your attorney makes the legal calls.

7. Your part

  • You confirm that you have the rights to everything you send us or put on your site (text, photos, logos), and that your business facts are true.
  • Reviews and testimonials on your site must be real, from real customers, and used with their permission.
  • You're responsible for your own legal pages (privacy policy, terms), your industry's rules, and your own hosting and domain accounts.
  • You review and approve anything we publish for you before it goes live.

8. Privacy and confidentiality

  • Our Privacy Policy explains what we collect and why. For kits, Link handles your payment details under its own privacy policy.
  • We keep your business information confidential and use it only for your purchase. We don't let any AI tool train on it.
  • We won't use your name, logo, site or words in our marketing without your written OK.

9. Limits on liability

  • To the extent the law allows, the most we'll owe on any claim about a purchase is what you paid for it.
  • To the extent the law allows, neither of us is responsible for indirect losses, such as lost profits.
  • Nothing here limits any right that the law says can't be limited.

10. Other companies' services

Your purchase may involve Stripe and Link, Google, Bing, Yelp, your web host, AI providers and others. Their own terms apply, and we're not responsible for their changes, outages or decisions.

11. Disagreements

  • Please tell us first, and we'll try to fix it.
  • New York law applies. Any court case goes to the New York state courts in Nassau County or the federal court for the Eastern District of New York. Either of us can use small claims court instead.

12. Changes to these terms

We may update these terms for future purchases. The version you agreed to at checkout covers your purchase.

Rules for each kind of product

14. DIY website kits

  • What you get: a download of the kit's files, as described on its page. You build and publish the site yourself, on your own hosting.
  • The license: one business, one website, under the Kit License. Your license code identifies your purchase, so keep it.
  • Help and fresh downloads: email us with your license code for help, an updated copy or a fresh download link.
  • Broken files: if a file is broken or missing, tell us within 14 days and we'll replace it.
  • Refunds: see the Refund Policy. You get a full refund until the download link is first used, and none after.
  • Shared copies: every copy carries its purchase's license code. If copies turn up outside the license, we may contact you and ask hosts to remove them.

15. Done-for-you work: Ready-Made websites and service packages

Getting started

  • Within 2 business days of your payment, we send a short intake form.
  • Your timeline starts when we have what we need from you: the intake, any files, and any access.
  • Work starts when we email you that it has begun.
  • If we don't hear back within 30 days, we close the order and refund you in full, since work hasn't started.

Access to your accounts

  • Some work needs access to accounts you own, like your Google Business Profile or your website host. You give access through our access form, using each platform's own invite or role. Please don't send passwords by email or text.
  • You keep ownership of every account. We use access only for your purchase and remove it when we're done. Please check that it's gone, or remove it yourself.
  • Platforms like Google can change their rules or suspend profiles at any time. We can't control or guarantee what they do.

Delivery and checking the work

  • When your work is done, we send it to you with a short list of what we did.
  • You have 5 business days to tell us if anything doesn't match the description. We fix those items at no extra cost. After that, the work counts as accepted.

Who owns what

  • Once you've paid in full, you own the work we made specifically for you, such as your text and custom design. We assign it to you.
  • We keep our own tools, templates and know-how. You get a permanent license to use any of them that are built into your work. For Ready-Made websites, section 16 covers the design.
  • Third-party and open-source parts (fonts, images, plugins, AI models) stay under their own licenses, in your name where possible.
  • We use AI tools in our work. Material made only by AI may not be protected by copyright, so you get whatever rights exist.

Refunds: see the Refund Policy. You get a full refund before work starts, and none once it starts.

16. Ready-Made websites

  • What you get: one of our finished designs, filled with your business's details and pictures. We connect its forms to your inbox, launch it on your own hosting account, and check it against our quality scorecard before handoff.
  • The design stays ours. You get a permanent license to use it for your one business, on one website, the same as the Kit License. Your own words, pictures and business details stay yours.
  • Facts and testimonials: we use only facts you confirm. Testimonials must come from real customers, used with their permission.
